Terms of service
These Terms of Service (“Terms”) apply to your use of ecoroll.co.nz (the “Website”) and your purchase of products from Eightysix Trading Limited trading as EcoRoll (“EcoRoll”, “we”, “us” or “our”).
By accessing or using the Website or purchasing products from EcoRoll, you agree to these Terms.
If you are using the Website or purchasing products on behalf of another person or organisation, you confirm that you have authority to act on their behalf.
Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other rights that cannot lawfully be excluded.
1. Using our Website
You must provide accurate, current and complete information when placing an order, creating an account or otherwise interacting with EcoRoll.
You must be at least 18 years old or otherwise legally able to enter into a binding agreement to make a purchase through the Website.
If you create an account, you are responsible for keeping your login details secure and for activity conducted through your account. Please contact info@ecoroll.co.nz if you believe your account has been accessed without your permission.
You must not misuse the Website, interfere with its operation, attempt to gain unauthorised access to it or its systems, introduce malicious software, or use automated methods to extract content or data without our permission.
We may change, suspend or discontinue parts of the Website where reasonably necessary.
2. Products and product information
We make reasonable efforts to ensure product descriptions, images, pricing and other information displayed on the Website are accurate and current.
Product appearance, packaging or other details may occasionally vary from images displayed online.
Products are subject to availability, and we may change or discontinue products from time to time.
If a product you have ordered is unavailable, we will contact you to discuss the available options. This may include an alternative product or a refund. We will not substitute an unavailable product without contacting you first.
3. Pricing and GST
All prices displayed on the Website are in New Zealand dollars and include GST unless otherwise stated.
Any applicable delivery charges will be displayed before you complete your purchase.
Prices may change from time to time. A price change will not affect an order that has already been placed and accepted.
Subscription pricing is addressed separately below.
4. Orders and payment
When you place an order, we will send you an order confirmation using the contact details you provide.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, there has been an obvious pricing or website error, payment cannot be processed, or we reasonably suspect fraudulent or unauthorised activity.
If we cancel an order after payment has been received and the order has not been supplied, we will arrange an appropriate refund.
Payments are processed using payment services available through our ecommerce platform and associated payment providers.
5. Shipping and delivery
EcoRoll currently delivers within New Zealand.
Shipping rates, delivery timeframes, delivery-address requirements, Authority to Leave and other delivery information are set out in our Shipping & Delivery Policy.
Please ensure the delivery information you provide is complete and accurate. If you notice an error after placing an order, contact info@ecoroll.co.nz as soon as possible.
Delivery timeframes are estimates and delays may occur due to circumstances outside our reasonable control.
6. Subscriptions
Certain EcoRoll products can be purchased on a subscription basis, with recurring orders based on the delivery frequency you select.
The amount charged for each recurring order will be shown when you create your subscription. You will be charged according to your selected delivery frequency.
You can pause or cancel your subscription, or change your delivery date, before your next recurring order is processed. Changes made after an order has been processed will apply to subsequent subscription orders.
You can manage your subscription through your online account. For help managing your subscription, please see our Subscription Support Guide or contact info@ecoroll.co.nz.
Cancelling your subscription will stop future recurring orders. An order that has already been processed is not automatically cancelled when you cancel your subscription.
7. Returns, refunds and order issues
Returns, refunds, exchanges and replacements are handled in accordance with our Returns & Refunds Policy.
If an order arrives damaged, incomplete or contains an incorrect product, please contact info@ecoroll.co.nz as soon as possible with your order details.
Nothing in our Returns & Refunds Policy or these Terms limits any rights or remedies you have under applicable New Zealand consumer law.
8. Third-party services
EcoRoll uses third-party services to operate parts of the Website and ecommerce service, including services for website hosting, payments and subscription management.
Your use of certain third-party services may also be subject to the relevant provider's terms and privacy practices.
Information about how personal information may be shared with service providers is available in our Privacy Policy.
9. Intellectual property
Unless otherwise stated, EcoRoll or its licensors own the intellectual property rights in the Website and its content, including text, graphics, photographs, logos, videos and other materials.
You may use the Website for your personal use but must not reproduce, distribute, sell, commercially exploit or otherwise use our Website content without permission, except where permitted by law.
10. Third-party websites
The Website may contain links to websites or services operated by third parties.
EcoRoll does not control third-party websites and is not responsible for their content, availability or privacy practices. A link to a third-party website does not necessarily constitute our endorsement of that website or its products or services.
11. Consumer rights
EcoRoll has obligations, and customers have rights, under the Consumer Guarantees Act 1993 and Fair Trading Act 1986, including guarantees and protections relating to products supplied to consumers.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.
This retains an important protection that was already expressly included in the existing Terms.
12. Liability
To the maximum extent permitted by law, neither EcoRoll nor you will be liable or responsible under or in connection with these Terms, the Website or the Products:
a) for any loss resulting from an event or circumstance beyond our or your respective reasonable control; or
b) for any loss of profits or any indirect or consequential loss, damage, cost or expense.
These exclusions apply regardless of whether the liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise.
To the maximum extent permitted by law, EcoRoll's total liability to you, and your total liability to EcoRoll, under or in connection with these Terms in relation to any individual order or delivery of Products, including a delivery made under a Subscription, is limited to the total price paid for that order or delivery, including GST and delivery charges.
Nothing in this section excludes or limits any liability, right or remedy that cannot lawfully be excluded or limited.
13. Privacy
We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable privacy law.
Our Privacy Policy also explains how we use cookies and similar technologies and how you can manage your privacy preferences.
14. Changes to these Terms
We may update these Terms from time to time, including to reflect changes to our Website, products, services, business practices or legal obligations.
Changes will apply from the date the updated Terms are published unless otherwise stated.
Changes will not retrospectively alter an order that has already been placed and accepted.
15. General
These Terms are governed by the laws of New Zealand.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce a right under these Terms, that does not mean we waive that right.
These Terms, together with the policies referred to within them, set out the terms governing your use of the Website and purchases from EcoRoll.
